- An interesting Highway Traffic Case: R. v. Duncan, stands for the proposition that it always pays to examine the elements of the offence and insure the Crown has done their job of proving each one. It is also a remarkable demonstration of judicial plain language use and, perhaps, a signal that Canada is developing its own Lord Denning(s).
